Why is calculatem pro legal? It gives advice on how to play the current hand. Isn't that against every TOS?

Thank you for contacting PokerStars.

Calculatem Pro does not use any information not available to any observer of the game, nor does it use any means to automate play or assist in cheating (such as sharing hole cards with others).

Therefore, this program, and others like it are permitted for use on PokerStars. Specifically prohibited are programs that share hole cards, or automate the play of the game so that it can run unattended.

You may find our policy on such software in section 5.5 of our terms of services at:

http://www.pokerstars.com/poker/room/tos/

This page links to an explanation of our prohibited programs policy at:

http://www.pokerstars.com/poker/room/prohibited/

A partial list of permitted and forbidden programs is available on that page as well.

Good luck in the games, and thank you for playing on PokerStars.

Best regards,

Rasa PokerStars Support Team

+1 for contacting them, even if their answer is completely useless. ;-)

Yes, I find their answer incoherent. By the reasoning given in this email, a program that shows how to play optimal push/fold ICM should be legal since it does not automate play or assist in cheating.

Here's a better answer (for Texas Calculatem but basically the same):

Hello Charles,

Thank you for your further email.

Texas Calculatem, as seen in the screenshots would certainly be prohibited for use here at PokerStars, and it was. However, the developers have since updated the program to remove direct advice for PokerStars to comply with our third party tools policy and as such, were returned to the permitted list. By the looks of things, they simply haven't updated the screenshots on their website (or a still valid for non-PokerStars tables).

Further, the URL that you provide (http://www.calculatem.com/screenshots.html) does not include any screenshots of PokerStars.

In addition, their website advises:

  * What is Advice Disabled Mode?

Due to the terms of service of some our supported poker rooms, the advice provided may be disabled or limited. At this time Advice Disabled Mode is effective on Full Tilt Poker and Poker Stars. You can view this at:

http://www.calculatem.com/faq.html

If you are concerned about their website, please contact them directly.

I trust that this has been helpful to you, but please feel free to contact us again anytime if we can help you further.

Regards,

Michael J PokerStars Game Security Team

The Poker Stars TOS used to read (see archive.org version from 2008):

Any software that offers advice on the appropriate action to take, and which is also programmable or configurable beyond a simple slider to choose a level of aggressiveness or tightness.

Under that wording, allowing Calculatem Pro made sense, because it isn't programmable. However, sometime in the past few years they've changed the wording to the following:

Any software that offers direct game play advice on the appropriate action to take.

I agree that the new wording does not seem to allow Calculatem Pro. I suggest you contact support@pokerstars.com and ask them. (Please update here if you get an answer :) )
